Article 1: Scope of Application

 These General Terms of Use, which may be revised at any time, apply to all ARCHIPAD products and the Synchronization Option service (hereinafter referred to as the Products and Services), as well as the website www.archipad.com. They supplement the General Terms of Sale available at the following link: https://www.archipad.com/conditions-generales-de-vente

Access to and use of the Products and Services, as well as use of the website, imply the user’s full and unreserved acceptance of these General Terms of Use (GTU).

The user therefore confirms that they have read and understood these GTU in their entirety before using the products, services, or the website www.archipad.com, and agrees to comply with them.

 

Article 2: Subscription

For clarity, the following definitions apply:

  • “Subscriber” means any individual or legal entity that has subscribed to a license for the use of the products and/or services;
  • “User” refers to an individual who accesses the products and/or services through a subscription taken out by the Client, in accordance with BIGSOOL’s offers;
  • “Website user” refers to any person visiting www.archipad.com.

Access to the products and services is provided by subscription under a non-exclusive, non-transferable user license.

The subscription is taken out for a fixed period (calendar year or other calendar period). It is automatically renewed unless the subscriber opts out. The subscriber must notify BIGSOOL’s sales department by email (sales@archipad.com) of their intention to terminate the subscription at least two months before the subscription’s expiration date.

At the end of the subscription, access to the products and services is no longer available.

The subscriber agrees to inform BIGSOOL’s sales department of any changes to the information provided during the order process, particularly billing details, bank account references, or credit card numbers.

To access the service, the subscriber will receive an activation link by email. This link is valid for a limited time. The subscriber must set their own password. BIGSOOL never has access to clients’ passwords.

The activation link sent by BIGSOOL and the password created by the user are strictly personal, confidential, and non-transferable. The subscriber is solely responsible for their use.

The subscriber agrees to restrict access to the products and services strictly to the end users listed on the invoice issued by BIGSOOL. The subscriber bears sole responsibility for any breach of these terms by any of the end users.

To preserve the confidentiality of login details, the subscriber agrees to promptly inform BIGSOOL’s sales department:

  • in the event of loss or theft of login credentials (confirmed by registered mail with acknowledgment of receipt);
  • when an end user leaves the organization, to allow for the closure of their personal account(s).
 

Article 3: Accessibility of Products, Services, and Website

 The products, services, and the website www.archipad.com are accessible via the Internet 24/7, except in cases of force majeure, events beyond BIGSOOL’s and/or the service host’s control, possible outages, or necessary maintenance work to ensure the service’s proper functioning. No compensation is due for such interruptions.

BIGSOOL commits to using all available resources to ensure quality access, reliability, and data uploading speed.

The site user and subscriber acknowledge and accept the characteristics and limitations of Internet data transmission, including connection costs. They must ensure their hardware and software allow proper access to the products, services, and website, and take appropriate measures to protect against potential malware.

The products and services are intended for professionals. BIGSOOL’s commitments are obligations of means. Therefore, BIGSOOL cannot be held liable—explicitly or implicitly—for any damage, direct or indirect, suffered by the user or third parties resulting from use of the products or services. Should BIGSOOL’s liability be established, it shall be limited to direct damages only, excluding any indirect damages such as data loss, lost opportunity, lost profit, or financial loss due to the use or inability to use the products or services. Compensation shall not exceed the amount paid by the user for the product or service concerned. This limitation is part of the contract’s economic balance. The client also waives any claims against BIGSOOL beyond two (2) years after the occurrence of a damaging event.

 

Article 4: Use of Content in Products, Services, and Website

All content in the products, services, and website—including texts, comments, books, illustrations, images, software, and the overall structure—is protected by trademark, patent, copyright, and database producer rights under Articles L 341-1 and following of the French Intellectual Property Code, applicable worldwide.

Access to and use of the service do not entail any transfer of rights to the user.

The user agrees not to use the products, services, or website for any purpose other than those authorized, and not to publish, distribute, or sell any content accessed, nor infringe—directly or indirectly—BIGSOOL’s rights.

Content may not, even partially, be reproduced, represented, lent, exchanged, transferred, or extracted in whole or in part to another medium.

The user and website visitor must not perform any qualitatively or quantitatively substantial reproduction, extraction, or reuse of content, nor repeatedly and systematically extract or reuse insubstantial portions of content. Use of robots, web crawlers, or any other software, device, or manual process to monitor or copy content without prior written consent from BIGSOOL is prohibited.

Any other use requires prior written authorization from BIGSOOL and may lead to legal proceedings.

The subscriber is also not authorized to:

  • use services, software, or any device or process to bypass restrictions or technological measures controlling access to services, including security features or usage limits;
  • place unreasonable or disproportionate load on BIGSOOL’s network or infrastructure;
  • take any action that could disable, damage, or alter the functioning or appearance of the products and services.
 

Article 5: Protection of Personal Data

BIGSOOL takes privacy and personal data protection very seriously and undertakes to implement appropriate measures to ensure such protection. It processes and uses personal data (hereinafter “Data”) in compliance with applicable regulations, including EU Regulation 2016/679 of April 27, 2016 (GDPR) and French Law No. 78-17 of January 6, 1978, as amended (“Informatique et Libertés” Law). Article 6: Termination

 BIGSOOL reserves the right to terminate a client’s contract and immediately revoke access to products and services, without notice, in the event of breach of any provision of these General Terms of Use, including non-payment.

 

Article 7: Changes to the General Terms

 These General Terms of Use are available online at www.archipad.com. They may be amended at any time by publishing a new version online, which shall be the only one applicable.

Article 9: Governing Law

These General Terms of Use are governed by French law.
