They supplement the General Terms of Sale available at the following link:<\/span><a href=\"https:\/\/archipad.com\/en\/conditions-generales-de-vente\/\"> <span style=\"font-weight: 400;\">https:\/\/www.archipad.com\/conditions-generales-de-vente<\/span><\/a><\/p><p><span style=\"font-weight: 400;\">Access to and use of the Products and Services, as well as use of the website, imply the user\u2019s full and unreserved acceptance of these General Terms of Use (GTU).<\/span><\/p><p><span style=\"font-weight: 400;\">The user therefore confirms that they have read and understood these GTU in their entirety before using the products, services, or the website<\/span><a href=\"https:\/\/archipad.com\/en\/\"> <span style=\"font-weight: 400;\">www.archipad.com<\/span><\/a><span style=\"font-weight: 400;\">, and agrees to comply with them.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><h2><b>Article 2: Subscription<\/b><\/h2><p><span style=\"font-weight: 400;\"> For clarity, the following definitions apply:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u201cSubscriber\u201d means any individual or legal entity that has subscribed to a license for the use of the products and\/or services;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u201cUser\u201d refers to an individual who accesses the products and\/or services through a subscription taken out by the Client, in accordance with BIGSOOL\u2019s offers;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u201cWebsite user\u201d refers to any person visiting<\/span><a href=\"https:\/\/archipad.com\/en\/\"> <span style=\"font-weight: 400;\">www.archipad.com<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Access to the products and services is provided by subscription under a non-exclusive, non-transferable user license.<\/span><\/p><p><span style=\"font-weight: 400;\">The subscription is taken out for a fixed period (calendar year or other calendar period). It is automatically renewed unless the subscriber opts out. The subscriber must notify BIGSOOL&#8217;s sales department by email (sales@archipad.com) of their intention to terminate the subscription at least two months before the subscription\u2019s expiration date.<\/span><\/p><p><span style=\"font-weight: 400;\">At the end of the subscription, access to the products and services is no longer available.<\/span><\/p><p><span style=\"font-weight: 400;\">The subscriber agrees to inform BIGSOOL\u2019s sales department of any changes to the information provided during the order process, particularly billing details, bank account references, or credit card numbers.<\/span><\/p><p><span style=\"font-weight: 400;\">To access the service, the subscriber will receive an activation link by email. This link is valid for a limited time. The subscriber must set their own password. BIGSOOL never has access to clients\u2019 passwords.<\/span><\/p><p><span style=\"font-weight: 400;\">The activation link sent by BIGSOOL and the password created by the user are strictly personal, confidential, and non-transferable. The subscriber is solely responsible for their use.<\/span><\/p><p><span style=\"font-weight: 400;\">The subscriber agrees to restrict access to the products and services strictly to the end users listed on the invoice issued by BIGSOOL. The subscriber bears sole responsibility for any breach of these terms by any of the end users.<\/span><\/p><p><span style=\"font-weight: 400;\">To preserve the confidentiality of login details, the subscriber agrees to promptly inform BIGSOOL\u2019s sales department:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">in the event of loss or theft of login credentials (confirmed by registered mail with acknowledgment of receipt);<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">when an end user leaves the organization, to allow for the closure of their personal account(s).<\/span><\/li><\/ul><div>\u00a0<\/div><h2><b>Article 3: Accessibility of Products, Services, and Website<\/b><\/h2><p><span style=\"font-weight: 400;\">\u00a0The products, services, and the website<\/span><a href=\"https:\/\/archipad.com\/en\/\"> <span style=\"font-weight: 400;\">www.archipad.com<\/span><\/a><span style=\"font-weight: 400;\"> are accessible via the Internet 24\/7, except in cases of force majeure, events beyond BIGSOOL&#8217;s and\/or the service host\u2019s control, possible outages, or necessary maintenance work to ensure the service\u2019s proper functioning. No compensation is due for such interruptions.<\/span><\/p><p><span style=\"font-weight: 400;\">Technical support is available to subscribers Monday to Friday from 9 a.m.\u201312 p.m. and 2 p.m.\u20135:30 p.m. via:<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Email: support@archipad.com<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Phone: +33.4.22.72.01.55<\/span><\/p><p><span style=\"font-weight: 400;\">BIGSOOL commits to using all available resources to ensure quality access, reliability, and data uploading speed.<\/span><\/p><p><span style=\"font-weight: 400;\">The site user and subscriber acknowledge and accept the characteristics and limitations of Internet data transmission, including connection costs. They must ensure their hardware and software allow proper access to the products, services, and website, and take appropriate measures to protect against potential malware.<\/span><\/p><p><span style=\"font-weight: 400;\">The products and services are intended for professionals. BIGSOOL\u2019s commitments are obligations of means. Therefore, BIGSOOL cannot be held liable\u2014explicitly or implicitly\u2014for any damage, direct or indirect, suffered by the user or third parties resulting from use of the products or services. Should BIGSOOL\u2019s liability be established, it shall be limited to direct damages only, excluding any indirect damages such as data loss, lost opportunity, lost profit, or financial loss due to the use or inability to use the products or services. Compensation shall not exceed the amount paid by the user for the product or service concerned. This limitation is part of the contract\u2019s economic balance. The client also waives any claims against BIGSOOL beyond two (2) years after the occurrence of a damaging event.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><h2><b>Article 4: Use of Content in Products, Services, and Website<\/b><\/h2><p><span style=\"font-weight: 400;\"> All content in the products, services, and website\u2014including texts, comments, books, illustrations, images, software, and the overall structure\u2014is protected by trademark, patent, copyright, and database producer rights under Articles L 341-1 and following of the French Intellectual Property Code, applicable worldwide.<\/span><\/p><p><span style=\"font-weight: 400;\">Access to and use of the service do not entail any transfer of rights to the user.<\/span><\/p><p><span style=\"font-weight: 400;\">The user agrees not to use the products, services, or website for any purpose other than those authorized, and not to publish, distribute, or sell any content accessed, nor infringe\u2014directly or indirectly\u2014BIGSOOL\u2019s rights.<\/span><\/p><p><span style=\"font-weight: 400;\">Content may not, even partially, be reproduced, represented, lent, exchanged, transferred, or extracted in whole or in part to another medium.<\/span><\/p><p><span style=\"font-weight: 400;\">The user and website visitor must not perform any qualitatively or quantitatively substantial reproduction, extraction, or reuse of content, nor repeatedly and systematically extract or reuse insubstantial portions of content. Use of robots, web crawlers, or any other software, device, or manual process to monitor or copy content without prior written consent from BIGSOOL is prohibited.<\/span><\/p><p><span style=\"font-weight: 400;\">Any other use requires prior written authorization from BIGSOOL and may lead to legal proceedings.<\/span><\/p><p><span style=\"font-weight: 400;\">The subscriber is also not authorized to:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">use services, software, or any device or process to bypass restrictions or technological measures controlling access to services, including security features or usage limits;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">place unreasonable or disproportionate load on BIGSOOL\u2019s network or infrastructure;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">take any action that could disable, damage, or alter the functioning or appearance of the products and services.<\/span><\/li><\/ul><div>\u00a0<\/div><h2><b>Article 5: Protection of Personal Data<\/b><\/h2><p><span style=\"font-weight: 400;\"> BIGSOOL takes privacy and personal data protection very seriously and undertakes to implement appropriate measures to ensure such protection. It processes and uses personal data (hereinafter \u201cData\u201d) in compliance with applicable regulations, including EU Regulation 2016\/679 of April 27, 2016 (GDPR) and French Law No. 78-17 of January 6, 1978, as amended (\u201cInformatique et Libert\u00e9s\u201d Law).
